Well I would have to say Satanism is a religion from all that I read. Frankly, court decisions have historically been careful to give even non-religion status with religion. As some of the commenters point out, there are some religions that do not focus strictly on worship of a deity. And even if we do make worship of a deity a central tennent of what is and isn't a religion, it would not take long for someone to say that Allah or Christ or Yahweh is not a deity but rather a false deity.
My guess is that a small town court may be initially hostile to him but get overruled. A smart judge will screw him over because he is an idiot and because of some of his behavior and not because of his church. The court is most likely to force a rehash of the visitation/custody agreement in order to resolve the problem without getting to a consitutional question.
